What Went On

The proceedings at the Supreme Court this week were a tough follow even if you could get the court’s abominably bad livestream to work. They’re all archived here now, but non-lawyers will probably glaze over quickly during the nine hours of intense legalese.

We’re not allowed to clip up any illustrative sections, on pain of possible contempt of court, so perhaps the best way to explain the key parts of what happened in a vaguely comprehensible way is by showing you some commentary from social media.

Please note that most of the people quoted below are lawyers and/or academics.

That seems to be the digest of it. The Scottish Government just spent goodness knows how much of your money sending KCs into the highest court in the land to argue the exact opposite of everything the Scottish Government has been strenously and angrily insisting in public for the last three years.

(That that’s what happened in court is that rarest of things, an interpretation of events which is agreed on by both transactivists and gender-critical feminists.)

Thus leaving their unfortunate counsel to have to present a case which is complete gibberish that even they can’t understand or explain without consulting a flowchart and taking an extended lunchbreak, but which they expect minimum-wage shopworkers and swimming-pool attendants to have complete command of at all times.

Five of the UK’s most senior judges will now spend several months trying to make some kind of sense out of it, and nobody knows what they’ll decide.

And that’s where we are now, readers.

Surely all these problems date back to 2004 when the Gender Recognition Act was passed by the UK Parliament.

What I find very disappointing is that I haven’t heard any politician suggest this might be the case.

Spot on, Ruby. No either way to fix it. The reason for introducing that Act has gone. Subsequent legislation allows same-sex marriage. GRCs are still possible in certain, very strict documents, while natal sex is retained for data and statistics, but they should, in no way at all, impinge even slightly on female rights.

The Scottish government, the Westminster government, the BBC and every other mouthpiece for these perverted men know perfectly well what they have done and are doing – Barbra Banda was deliberately chosen to rub women’s faces in this s**t. I don’t care if she was thought to be female at birth, or, at least, I do feel sympathy for his/her predicament; by puberty, he/she knew he/she was male; and so did everyone else.

These larpers and TRAs have conned everybody and they still suck public money out of the SG. A total capitulation and cowardice rules now. I’m not kidding: women are going to pull out of what is left of the social contract. It might take time, but, if this case is lost or just remitted back to parliament, we will start to withdraw from every social, political and legal situation as out stands and start setting up our own. A state within a state. If we don’t, it’s Afghanistan for all of us.

It’s worse than that. As Michael Foran has pointed out the UK almost uniquely has decided that ECJ rulings will form precedents in UK domestic law.

So even if we were to rescind the GRA of 2004 it would have little effect on the law because of rulings by the ECJ.

Until that court can be convinced to comprehensively row back on those we are stuck with these in our laws.

Supreme Court told to uphold ‘ordinary’ definition of woman

« Representing campaign group For Women Scotland, Aidan O’Neill KC urged the UK’s highest court to rule in favour of its appeal against Scottish Government guidance which allows men who identify as women to take women-only positions on company boards.

‘Laughing stock’

« Earlier this month, the National Records of Scotland (NRS) came under fire for recording gender identity rather than birth sex in the official death registry.

« Those with GRCs are automatically recorded as the opposite sex, but the NRS revealed that it may also change a deceased person’s gender identity on appeal from friends or relatives.

« For Women Scotland’s Director Susan Smith explained that this would skew official statistics on diseases and affect subsequent allocation of funding.

« She said: “Conflating sex with gender doesn’t just risk making Scotland a laughing stock, it may also risk lives and cost the public purse.” »

The Bill provides transsexual people with the opportunity to gain the rights and responsibilities appropriate to the gender in which they are now living. At present, transsexual people live in a state of limbo. Their birth gender determines their legal status.

Maybe politicians are reluctant to criticise the GRA 2004 because their parties voted that birth gender should not determine one’s legal status and that if you are ‘living as a woman’ you are a woman.

many years ago I worked with a urology surgeon who had created a “penis” for a woman who wanted to become a man.After years of hormone treatments, psychiatric counselling, lengthy surgery, the “man” could urinate standing upright. 2-3 years later “he” returned to the surgeon, fiancee in tow, asking about having children. I’m not sure to which KC you are referring. The irony perhaps, as the KC for the appellants mentioned, is that the only women KCs appearing in the case were those representing the Scottish Government. In my humble opinion, I’m inclined to agree with the comment quoted in the W o S article by Ian Smart to the effect that the Court are likely to conclude that the law is an ass but that it is for Parliament and not the courts to sort out! I thought that was broadly the position adopted by the advocate for the EHRC who had intervened and in some respects appeared to support the Scottish Government case but at the same time also agreed with many of the points put by the appellant’s (FWS Ltd) advocate.

Very true, but, anyone listening to the FWS case would have been made aware just how many times the painfully slow progress of women towards full legal humanity has been undermined in law and in the courts.

Every little step has met with opposition initially, then, later attempts to turn the clock back again. ‘Trans’ is just the latest form this on-going misogyny has taken. It really is time for women to turn their backs on all of it and set up their own institutions, parties, etc. and demand their fair share of taxes and all resources accruing to them as half the human race.

The next step will be to try and prove that we are not actually human, but some kind of off-shoot that never made it – inferior men whose biological status and bits never made it to full fruition.

Sorry, chaps, there are two sexes and each is determined in utero, both starting off as female; each is very physically, psychologically and physiologically different from the other in lots of ways; and each is absolutely essential for the procreation of the species. Neither has any special features that makes either sex dominant in any way whatsoever.

Men have physical strength, but, eventually, that will become redundant as human existence progresses. The whole ‘trans’ lobby nonsense is regression on stilts.

What struck me was how the Scottish Government sent in KCs so unprepared & unaware of the entire trans debate. I’m assuming they want to win this so they can push their legislation through but I got the impression as the day went on and the judges informed themselves that even the SG KCs thought the entire thing was a clown show.

How much is this all costing us at a time of austerity by Westminster and Holyrood is a crucial question. Allow me to help. Men cannot get pregnant. They have no uterus or ovaries, they have no birth canal, or fallopian tubes. They have no capacity to allow for the gestation of a human developing foetus, nor to even create one. Their hormones would disallow any notion of pregnancy, and even if such a strange thing were to happen, they could not give birth naturally, as their pelvis (unlike an actual woman’s ) is the wrong shape, thereby preventing a baby descending the non-existent birth canal. I could go on, but you get the point.

ANY person, ANYWHERE who talks about nonsense like a ‘pregnant man’, needs to see a head doctor urgently – even if they are a KC, or government minister.

No wonder actual REAL women, are so pissed off.

I think there are two strands of lunacy here.

As you say, men cannot be pregnant. But people who swallow the lie that “transmen are men” (they would put a space after trans; I’m not going to indulge that) are then able to talk about “pregnant men”, by which they mean females who identify as men, who can and do become pregnant.

But when Swinney says that men cannot become pregnant, he’s probably talking about males who identify as women, thereby deliberately or otherwise maintaining the confusion.

If so, he’s of course admitting that males who identify as women are still men, and females who identify as men are still women.

And yes, as a real woman, I am mightily pissed off by the whole thing.

What is more damaging to anyone’s health than a combination of poverty and hopelessness? That’s what being tied to the Union means in real terms.

The SNP ‘brand’ is fucked, aye, but that hasn’t made the msm ‘news’ yet. So many inquiries/revelations/trials in the offing but there’s always just enough of a delay, for whatever reason, to kick it all down the line just beyond that next election.

The Arla controversy is, ostensibly, about virtue-signalling capitalists tinkering with the food chain. But that’s not why people are going ape over it. It’s about trust. As consumers we’re entitled to know what’s in the product – be it an injection, a basic food or a political party – and we’ll buy it if we know exactly ‘what’s in the tin’. I have a golfing pal who receives an old age pension. Last year he was awarded £500 for the winter fuel allowance. In reality he needs neither. Feeling a bit guilty he decided to put £250 cash, in two separate envelopes, and stuck them through the letter boxes of two different pensioners he knew were struggling. He did this anonymously.
This year, no WFA but he has decided to do the same again. It got me thinking. I am not yet of pensionable age, but am financially secure and have decided to follow his example.
Maybe more of us, who are in a position to do so, should consider doing the same.

Universality is worth saving. Just think what Scotland would be without universal health care and education. The principle that all pay in and all benefit is sound. Found it fascinating to learn about the cctv cameras in London . . . first I’ve heard about that. I’ve watched one of Nima’s interviews before and he’s such a good listener, very focused, never interrupts.

Not completely off topic, but one of my fave hobbies being a skint saddo, is using google maps street view to travel round other countries that I have next to no chance of ever being able to visit.

I’ve recently been on a wee tour of some Russian (and Hungarian) towns and cities (not Moscow/Budapest) and my eyes have been opened to how pleasant and well maintained so many of them are. I’m not talking about the tourist attractions within these places, but of the suburbs, shopping precincts, the places where locals go, and the streets where they live. Immaculate, leafy, clean, well maintained.

Ok, in the outskirts of some cities you’ll find a suburb consisting of a grid of dirt tracks (no tarmac) with housing on either side, and the housing ranges from modern, new build fortresses (cartel, keeping a low profile) to more ramshackle dwellings . . but the house to plot ratio is something like 20% and there’s trees and lush vegetation everywhere. No fly-tipping, no rubbish, no graffiti. The potholes no worse than here.

I always try and find a ‘shithole’ housing scheme, a huge tower block complex for example, and I’m specifically looking for signs of over flowing dumpster style bin areas, graffiti and burnt out motors . . . there’s been so many large towns/cities where I’ve been unable to find any. I can only assume that many Russians and Eastern Europeans have better funded public services/infrastructure than the UK. I pick my street view explorations at random, usually places I’ve never heard of, and I always check the footage is recent.

Sadly, Mac, what will happen is that palliative care and care homes will receive even less funding and as more and more old people struggle to find somewhere to receive live-in care the facilities will become rarer than hen’s teeth with the result that geriatric people will have nowhere to go and will be forced to ‘choose’ / opt for assisted dying. A self-fulfilling circle as more and more opt for the assisted route there will be even less demand for live- in care until we will reach the point where it becomes compulsory euthanasia at 75!

I would very rarely disagree with you, Mac, but have to correct the misconception that when we get advanced dementia our lives are less valid than anyone else’s. Yes, it’s a nightmare at times. Everyone is different but, from experience, I have no doubt that when someone feels safe and loved there are moments of warmth and humour that far outweigh the difficult times. These are what you remember.

The pity is that, as a society, we tend to undervalue older people. We also don’t pay care staff nearly enough for the fantastic job they do. There’s nowhere near enough backup so families get worn down and everyone suffers. Just another example of a broken system, sadly.

Speaking to nurses in this field about that… they say that some days they think it is worthwhile and others they do not.

The whole system is insane IMHO.

They are offering them zero treatments, nothing.

Yet they have this super expensive structure of ‘care’ homes around them, keeping these poor people alive, to suffer for as long as possible. Why?

Having seen it, I consider it cruel.

And of course while they keep them alive they use it as an excuse to steal their life savings.

I did hear there was a sharing of expertise and lessons learned from the fire at Windsor Castle, but beyond that, the information I have is thin.

I’m also aware the French operate their spectacular Compagnons du Devoirs apprenticship schemes across multiple trades, which is probably the best training regime I know about.

For example, in the UK, an “advanced” Stonemasonry apprenticeship takes 4 years. A Compagnon apprenticeship takes 9. Kinda tells you something, no?

Guédelon Castle is another spectacular and successful initiative which puts other countries to shame. Show me any other country so dedicated to its culture.

If only Scotland would adopt the French model… Yet that will never happen unless or until Scotland, or even the UK society for that matter, adopts a more respectful attitude towards it’s tradespeople.

Sadly there’s no such thing to be seen on any horizon, while trash built mediocrity hoovers up the nation’s income and land; a complete racket bouyed up by deliberately orchestrated housing shortage designed to ensure demand must always outstrip supply. Maximum money out for minimum money in – “living the dream” UK style.

Save the trades from extinction, or starvation, then a catastrophe like Windsor or Notre Dame can be remedied, or even rebuilt from scratch. Pickle the buildings in aspic, spend the budget on an army of curators and custodians, then when catastrophe strikes there is no functional capacity there to fix it, and we are all left mulling over a mountain of records and pictures, but impoverished by its loss.

Watching the STV live stream – as guests are leaving St Giles the TV is focussing only on the guests – not once have we seen the waiting public lining the streets – I guess we are meant to think that there is only a handful of people there.
As various people leave the crowd is applauding then 10 minutes or so into the scene the crowd started to chant – immediately the sound was muted. And, at the point where John Swinney possibly might be leaving, the vision but back into an empty St Giles and focussed on the Golden Eagle on the lectern….. censorship in Scotland? Naaaw!

Very poignant day with Alex Salmond, but thinking about it brought back a “goosebumps” memory.

I’m confident there’s a big difference between A: the percentage of Scots voters who support the theoretical concept of Indy, and B: the percentage of Scots voters who would vote for Indy if it was on the ballot, with A much greater than B.

I’m convinced the Plebiscitary Election route is the only path open to Scotland, because it needs no WM authorisation to happen, and in the right hands, it can be managed, with or without the engagement of the opposition, so as to show the true support for Indy at the ballot box.

Sadly, I notice that every time I push the Plebiscitary Election idea, it’s shouted down.

Peter A Bell’s new indy party was launched today in Perth.

“ANEW political party launched today with a single mission in mind: independence.
The New Scotland Party held its launch event at the Salutation Hotel, Perth and promises an unconventional but entirely member-led approach to independence.
Peter A Bell, the founder and interim leader of the New Scotland Party, is a self-described part of the “radical” wing of the independence movement and staunch republican.
A blog post by Bell summarises the political compass of his new party, reading: “New Scotland Party is a national and constitutional party solely focused on the issue of Scotland’s constitutional status and settlement.”
The party manifesto has a single aim: independence. The manifesto seeks a total revocation of Section 30, a law wherein Westminster may restrict the Scottish Parliament’s legislative authority.
The manifesto also calls for all Scottish and UK elections to act as a way to “facilitate the exercise of Scotland’s right to self determination”.
Bell explained: “We do not take any position on any issue except the constitutional issue. The constitutional issue has to be separated from all other issues. It has to be treated in isolation as it sits above and around all other issues.”
He continued: “We are entirely focused on the constitutional issue. [People] won’t be voting for a vision; you’ll be voting for the freedom of the Scottish people.”
The six-point manifesto also acts as a proposed 2026 election pledge for other major political parties. Using the SNP as an example, Bell explained that: “The idea we can do without the biggest party is a nonsense. We can’t. You [instead] work within the SNP to get [our] manifesto adopted.
“That is the objective, to get all of the nominally pro-independence parties to become true parties of independence by adopting the manifesto for independence. That way every vote, for every independence party counts as a mandate for the manifesto.”
The New Scotland Party will not run in the upcoming 2026 Scottish Parliamentary election.
“We don’t see any need [to stand candidates in 2026]. It knocks on the head of all that nonsense of splitting the independence vote, what that really means is splitting the party vote. If we have the manifesto for independence adopted then it wont matter if the party vote is split as it will still be a vote for the manifesto for independence,” Bell said.
One attendee asked whether this makes the party a lobbying group, to which Bell responded: “We are acting as a lobbying group initially, but it is a political party.”
Members will become equal shareholders and directly influence policy and stances. There will be no central headquarters, instead The New Scotland Party will carry out the majority of its business online.
Bell explained that this structure is intended to better represent membership: “Commonly, political parties have been structured on a branch basis with a central headquarters. There is evidence enough that this structure tends to create islands of power.
“This is a formula to creating cliques of careerists who vie for the control of the party. Where is the membership in all of this? Out in the cold. We reject this model. We intend to be a national party dealing with national issues and organised on a national basis.”
However, no plans for a vetting process for new members are currently in place.
Bell began the launch event by addressing the clash with Alex Salmond’s memorial service, which took place during the party’s launch, at St Giles’ Cathedral, Edinburgh.
“What ultimately prompted the decision to proceed as planned with the launch was the realisation that the clash with Alex Salmond’s memorial service is in fact a happy coincidence,” Bell explained.
“Alex Salmond brought Scotland’s cause into the modern age. He launched a new phase in the struggle to liberate Scotland from the oppression of a grotesquely asymmetric political union.
“[The memorial] marks the end of a phase to the independence struggle, while [this] signals the start of a new phase.”

Cheers for your effort Ian Brotherhood in filtering out what you deemed were worthy btl comments from a sea of trolling, and posting other articles too.

Still a bit miffed at the continuing fragmentation of folks that are supposedly supportive of returning Scotland to self-governing status.
If something needs done you need to focus on getting on with that task and not be overly distracted with events and matters that are totally outwith our control.

There doesn’t even seem to be the desire to have conversations on the way forward now as folk splinter off and do their own thing.
Crazy strategy there because it just allows others to take the initiative and fill the void.
A few days ago folk were bigging up a petition for another GE, but what is the point in that when there has been no effort put in to develop an alternative to vote for.
I could see this situation developing years ago as egos would not yield an inch from their way or the highway to work with others. That is not helpful in the slightest because the only way to make progress and reach people in our communities is for activists on the ground to interact with the electorate in their areas.
Pissing around on the internet in wee bubbles of political anoraks has accomplished little of note over the last years.
Voter turnouts are abysmal now and highlights that whatever internet bloggers, political Parties, or YES groups are doing needs to have a serious reset on how they go about things.

I thought Duncan Hamilton’s speech (eulogy?) was exceptional. He is a man of great intellect and someone who understood Alex and what motivated him. I would vote for him.
It was noticeable that the ‘big’ media stations were trying to show as little public support as possible – as if there was not much interest in the proceedings and as earlier reported the sound was automatically muted as soon as the unseen crowd began to chant ‘Scot- land, Scot-land’
I’m amazed that they showed any Saltires at all, especially on St. Andrew’s Day.

I do recall your suggestion but the problems with it are firstly getting significant uptake, but for me the underlying issue is that the NuSNP aren’t worth saving, and efforts would be far more productive if they were spent creating an alternative strategy* rather than trying to convince a Party that is now stuffed full of sellouts and grifters to alter their position purely on self-preservation motivations.
Two Scottish elections with #BothVotesSNP has shown they have zero interest in working with anybody else.

*You’ll know my strategy is to ditch Party politics and go with non-party affiliated independent candidates on a much more direct democratic and therefore less likely to be corrupted manifesto.
But like your suggestion, it gets no take up because the insane want to continue doing the same thing over and over again and expect different results.
I can’t even get a conclusive answer to which election to use as a plebiscite for returning Scotland to self-governing status.

Holyrood Parliament is an instrument of the Scotland Act and UK constitutional matters are reserved to Westminster.
IIRC Stu has also posted an article which touches on the subject of the potential difficulty of using a Scottish election as a plebiscite with unionist controlled councils possibly making it difficult because UK constitution is not a devolved matter.
It’s frankly farcical that there is still no clear and concise method for Scotland to express its will in matters of self-determination after the material change in circumstance of the EU Vote.

To be fair, Peter has acknowledged his error in having continued to support the SNP when others had realised that the SNP leadership were the problem.
I think he has started the New Scotland Party as a vehicle to publicise the Manifesto for Independence and thus get other independence parties to adopt the Manifesto i.e. an umbrella grouping. The Manifesto was written several years ago by Geoff Bush and others, the Good Guys of the SNP [so no longer in the SNP, of course]. I confess that I am a little confused…. 🙂

In this he’s correct , the other Parties should indeed adopt these strategies . But given that he does not intend to stand any candidates in the next S.E , i see no possibility of them doing so – least of all the sub-zero credibility SNP .

The only way the SNP might get onboard with such strategies is if they felt threatened electorally ( eg how Reform have threatened the Tories to the point where the latter has donned the philosophically – tattered rags of the former ) . As NSP cannot present any such threat , there is zero pressure from that quarter to bring about some kind of radical change of direction from the SNP .

Interesting. While I find it hard to tell objective fact from the conspiracy theories and propaganda regarding Covid, we were undoubtedly lied-to about it. First, we were told that herd-immunity would quickly arise. Although infections rose and fell in a bell-curve, herd-immunity seemingly never happened. Then we were told that people who had had Covid and had also had the vaccination would have ‘super-immunity’. That evidently wasn’t the case either, as the pandemic continued and people were repeatedly reinfected despite having had the vaccinations. I suspect that Covid (or the vaccines) has caused serious permanent harm to many people’s health and has reduced their life-expectancy. Wonderful, isn’t it?

SCOTTISH SCHOOLING IS A DATA “BLACK HOLE”

Professor Lindsay Paterson of the Commission on School Reform and the University of Edinburgh said:

“Scottish schooling is a black hole out of which no information escapes that might be useful in assessing progress and informing policy.


“This absence of data means that it is effectively impossible to track learning or teaching, to assess the outcome of schooling for leavers, and therefore to evaluate government policies intended to improve schooling.

We already have good-quality evidence from the Scottish National Standardised Assessments and the SQA assessment process, and by bringing these together and adding a regular sample survey at key stages, we can generate critical data.

Audit Scotland says nothing about how Scotland acquired its poor health – deindustrialisation or of the lasting effects of it. It says nothing of the underfunding of services in England that gets transferred here via the lower block grant.
