So what we only suspected is now official. In a response to The National, the BBC have confirmed that they were behind the termination of this site’s YouTube channel.

We have to admit, that “irrespective of the political views” line is a classic.

All joking aside though, we must confess to a modicum of shock. Despite everything, we still at least partly thought there was a chance that it was down to some malicious impersonator, but the state broadcaster has now publicly acknowledged that it demanded the removal of some short clips of news and current-affairs programmes, published in full accordance with the fair-use exemptions of copyright law, and all of which identified the sources of the clips used.

When YouTube have stopped making quite such a gigantic pig’s breakfast of all the technical aspects of the termination, we will of course be filing formal counter-notices for all the allegedly offending items. YouTube’s normal procedure in such cases is to reinstate the videos, having provided the complainant with the necessary details to bring a court case should they decide to do so.

So either our channel will be back online soon, or YouTube will be making a special exception to its own rules in order to suppress a political voice at the behest of a supposedly impartial media behemoth, or the BBC will be taking a website to court for reporting the news.

Either way, this could be about to get very interesting.

[EDIT 9.18pm: We just received a response from YouTube to our latest counter-notice, which listed the 60 most recent videos posted on the Wings channel. According to YT the BBC had only objected to ONE of those, and after some effort we managed to identify which one it was. It was the first one from this article.

Which is to say, it was an interview WITH ME from Sunday Politics Scotland. The BBC has had YouTube shut down my entire channel for supposedly infringing its copyright by posting a video of myself. This story gets madder and madder.]

Apparently Scott Arthur got a load of BBC material removed too. It will be interesting to see if any more “offenders” will be reported. Of course, the Rev is the only one who is a card-carrying journalist, so his need for the material is greater than most. It makes the oddness of the attack on him more heinous, but also hopefully more easily challenged.

Actually, the BBC response is very badly written. It is also inconsistent, in the first para it says it did not ask for the whole channel to be removed, then later talks about a process in place to challenge take down orders. Looks like the statement was prepared in a bit of hurry, without their lawyers’ involvement.

Just sent my FOI request to the BBC.

“Can you provide me with a list of the Take-Down Requests that the BBC has issued for YouTube content since January 1st 2017, for individual videos and for channels”.

Expecting a stock reply, but at least it occupies their time, and I’m not paying for it anyway since I don’t have a TV license.

The down-side is that I had to give them my name and address, but hey ho they probably had it anyway after the police seized WOS equipment last year.

Not sure about demographic effects on the YES:NO ratio. I did a back-of-the-envelope calculation in 2014 and estimated it would be 10 years (ie. 2024) before the young YES wave came through to make it more than 50%. However, that was before EVEL, BREXIT and the most incompetent, nasty tory government in living memory. As a result, 5-10% have already swithed to YES before a campaign has even begun.

The elephant in the room is the (5%) group of YEStoNO switchers (ie. BREXIT supporters). Not sure how they will go – difficult to predict. What I is that if it were not for these strange voters, we would already be home and dry.

Stu, under the Data Protection Act you can demand a Full Record Print of every piece of information on you held by the BBC.
For a small fee they are legally obliged hand over copies of every piece of information held by them relating to you and bearing your name.
Perhaps that might be one avenue to get to the bottom of this puzzle.
BTW it is illegal for them to shred and delete any info on you once the request has been made.

The only ones they have injured are the BBC themselves and, of course, YouTube owned by Google.

I may decide to change my search engine to Dogpile or even Microsoft Bing. Who the hell wants to support a company that is hostile? There are always alternatives on the web, as certain companies who got too big for their boots, have found in the past. I was just reading today that even Facebook was losing user.

I agree with you Meg, very much so. All the Beeps have to do for any legal biased claims is show a couple of right wing sites (that we probably have never heard of) that they’ve taken down, and not only does it become much harder to prove political bias, but any reporting of the case (which the Beeb would have a large chunk of) Wings would be lumped in with the same bunch.

A lot of their lying is by omission and it is extremely difficult to prove, and always has been. Prof Roberston did some absolutely fantastic and time consuming work gathering evidence of it – in a generic format – for an individual case I suspect it would be even harder. Very expensive, and very time consuming.

Is it possible they’ve been flexing their muscles with You Tube, testing the waters so to speak.

Public protests on the other hand – I think that’s a goer.

It’s suspect in that Youtube took down the whole channel. Why would they do that? I have heard they have a habit of taking sites down, an ask questions later, attitude.

Not good enough youtube! They do what they are asked by the powerful it seems. Internet neutrality is on a very shoogly peg. We live in very interesting and different times, to what went for news, and politics and democracy in the past.

The BBC are an utter disgrace, what more is there to say. It is sinister to have such an organisation wielding power, when it is meant to be a public body, and when the people are actually strong armed at least, into paying for it.

What would the BBC do without public money? It’s a lot of money I presume, given the population of the whole of the UK. Anyone know how much?

They lost their case years ago. There hasn’t been a case of anyone being convicted of non-payment of a TV licence in Scotland for over 5 Years but 10s of thousands have been jailed in England see this:-

The BBC’s licence chasers are actually breaking the law against coercion in Scotland by the way they operate.

Under Scots law it is a criminal offence to demand money with threats and it even specifically mentions the threat of legal action and every begging letter the BBC contractors send out has an implied threat of legal action.

BTW: I’ve posted that information here on Wings on several occasions. They also break the law of harassment and/or stalking. I have a wad of letters at least 1″ thick and I haven’t even bothered saved them all.

The big joke is that I’m well into my 80’s and could thus have a free licence – but there is no legal duty to tell the BBC anything and their so called, “Officers”, that they imply are law enforcers are nothing of the kind. They simply work from an office. To the best of my knowledge, and I’m virtually permanently housebound, they have never called at my address.

So just ignore them and, if they call do not tell them anything except to leave your property. Doing so cost the BBC money so let them get on with their illegal activity – it’s like fining the BBC.

For some odd reason somebody who shall remain anonymous, passed me the BBC internal module which is a pre-requisite for anyone in news and political affairs. I studied it and then did the attached test, and manged to pass with distinction, with 13.5%, apparently the highest mark ever – in fact the only mark in double figures.

Suitably armed with the appropriate tools of the trade I applied my new-found knowledge, not to the usual SNHS story, but to the question of just how many Unionists there are in the whole of Scotland, and arrived at the figure of 3,159 and a third.

The BBC were happy to show my full report, and you can see the 30 minutes of footage on Youtube.

We just received a response from YouTube to our latest counter-notice, which listed the 60 most recent videos posted on the Wings channel. According to YT the BBC had only objected to ONE of those, and after some effort we managed to identify which one it was. It was the first one from this article.

Which is to say, it was an interview WITH ME from Sunday Politics Scotland. The BBC has had YouTube shut down my entire channel for supposedly infringing its copyright by posting a video of myself. This story gets madder and madder.]

So if I have got this right, and I probably haven’t 😉 , the BBC “complained” to YT about a video containing an interview with oor Stu who just so happens to be … erm …the head honcho of … erm … Wings over Scotland and its associated YT channel because of … erm … copyright? 😉

The BBC DOES actually know that oor Stu IS the person IN the video and as such THEY are denying HIM the right to “view” and share a video of HIMSELF … right? 😉

Will someone please remind me again … am I correct in thinking that to be one of the top men at the BBC you DO actually have to have a .. erm … BRAIN and … erm … some INTELLIGENCE in how to use it … right? 😉

As far as I know it is also the case that you cannot be jailed for debt in Scotland. Not paying the tv tax would be considered a debt, it’s why they can’t really do much if people do not pay it in Scotland. Scots law.

To lock people up in England for not paying the tv tax is a travesty of justice, via English law.

Maybe didn’t want Rev focused on the need for individuals stocking up on food/medicine, because he may have hit on something the Tories didn’t want people speaking about on social media.

If I remember correctly, the Rev mentioned in a tweet, that the Tories were telling people that THEY the Government, were stocking up on food and medicine, in case of a ‘No Deal’
however, it soon began to emerge, that the UK does not have the facilities to stock up large amounts of food.

Rev wrote in a tweet that this was the Tories telling us that WE had to start stocking up on food.

Being the deceitful liars and cowards that they are, the Tories didn’t want to have to deal with the ensuing panic that would result (they also wouldn’t want the potential disaster to impact on their holidays) so they just put enough information out there, for people to start thinking they needed to start preparing for the ‘worse case scenario’.

So, did someone see revs tweet (we know they watch it carefully) and realise that it could start the panic that they were desperate to avoid, and get on to the BBC to order them to do whatever they could to distract Rev?

Can you have a look at your timelines Rev and see when you tweeted about the Tories really wanting us to start stocking up on food, then when your YouTube channel was pulled.

Might be wrong, but you never know!

I could just imagine this being before some super punishment in kind court, where the ruling was that the BBC had to immediately start showing all the censored youtube clips solidly between the hours of 7 am to 11 pm on workdays, with pauses and a voice over from the Rev using his article’s material for each one, and wasn’t allowed news or any other program including the dreadful breakfast TV until it was done. The BBC are their own worst enemy. Let me put it this way so you can see what I mean.

It isn’t the SNP that has seen the Scottish people stop paying their licence fees in very large numbers – it is the BBC themselves that make the programmes that Scots no longer want to view.

It isn’t the SNP/SG or independence supporters that have alienated the BBC it is the BBC that have alienated their own former viewers. What’s more social media is like London busses – if one fails to turn on time there’ll be another couple along in a minute.

I used to do regular YouTube videos of Stuff I videoed and edited myself but got quite fed-up with having no control over the ads that they inserted within my stuff.

I already posted a link to an article that quotes a FOI that states not a single person in Scotland has been convicted of Licence non-payment in five years. I’d bet there will be a further big dip in TV licenses as a result of the BBC/YouTube actions.

I was just over taking a look at Craig Murray’s site where he’s covered the BBC own goal fiasco. In doing so, he’s highlighted the yootoob video “London Calling.”

I decided to watch it again and it’s amazing what you forget, such as the piece on Rory Stewart Tory MP for Penrith. The BBC afforded him the opportunity to produce a one hour programme (wonder how much that cost?) to convince us that, well basically we’d be Better Together. No mention that he was not a historian, but rather he’d been (still is?) an MI6 Officer.

Craig Murray had met Stewart, when Stewart was working in Afghanistan as an agent, during the time that Craig was the UK Ambassador in Uzbekistan. Stewart has also been tutor to Prince William and Harry and his father had been Depute Chief of MI6. What a tangled web they weave, eh? All in it together right enough.

Wikipedia covers his time in Afghanistan as Stewart walking on foot across the country, and others, visiting villages and so on. No doubt some Philip Cross “interventions” going on there. He’s now Big T’s Minister of State at the Ministry for Justice – Minister of Prisons.

Note too that the BBC didn’t go out of its way to offer the same deal to anyone on the Not Better Together side, discrimination, even although over £300,000 a year wings its way down south to the Treasury. Well worth having a look at the video, if you haven’t seen it before. Better still before it disappears into the ether.

Oh! I had that one figured out years ago. It is a sign of insecurity and while the Welsh, Irish and Scots have a very clear idea of who they are and what their culture is the English have no clear idea of who they are or what their culture is.

History, though is the key. Scotland has never been a invaded and taken over in the way that England has. It is still the same today, we do not ghettoise immigrants we assimilate them and they become the people of Scotland. The English expelled the Jews for hundreds of years but Scotland is the only European country that has never had an official pogrom against the Jews.

The worst thing in Scotland was Christian Sectarianism and it still blights us today and, remember, it is the main reason behind the Treaty of Union.

The BBC don’t get the Licence money to keep.

The BBC get an agreed Annual Grant from general taxation. Read the bloody Licence and see what it says. You pay the Government for permission, (that’s what a licence is – official permission to do or have something – in this case the Government’s permission to watch live video broadcasts from anywhere by any medium

If you want an answer then look up what the BBC & the Government agreed the BBC would get as a grant. It is on the net. In addition, as the BBC is a private corporation, it sells many goods and services throughout the World including, believe it or not, toys to children. Things like toy puppets that feature in BBC children’s cartoons and puppet shows. recordings and programmes like soaps and Dr Who series. Audio recordings of both programmes and music and much, much more.

They probably do not publish their sales figures but the government grant from general taxation is agreed by a parliamentary committee so will be recorded in Hansard.

I repeat The BBC do not get to keep the licence fee and they do not even collect it for the government now. That is now done by CAPITA.

Most interesting thing the Rev said in this article for me was this:

“YouTube’s normal procedure in such cases is to reinstate the videos, having provided the complainant with the necessary details to bring a court case should they decide to do so.”

So now that the Rev has stated “we will of course be filing formal counter-notices for all the allegedly offending items.” then the BBC have 10 business days to respond “with evidence that they have initiated a court action to keep the content down.”

Correct but you can, according to the BBC Licence chasers, be fined up to £1.000 and they do threaten you with that in their begging letters. That, under Scots law is the criminal offence – coercion. It even mentions that a threat of legal action is coercion. Also, there is no English style law of trespass in Scotland but there is of invading privacy and they are not allowed to, “investigate”, only to enter into close proximity to a private dwelling to contact the occupier and that can be prevented by a simple notice like, “No Cold Callers”, or No Hawkers”.

I may be wrong but it couldn’t be a debt unless the person had agreed to pay for a licence.

Anyway, they have no legal standing and do not even have a right to assume who is an occupier and no legal right to be told anything by anyone. So don’t tell them anything not even that you do not require a licence. They do have a right, to ask for a legal search warrant but if they do not know who the occupier is they have little chance of getting a warrant.

A person being harassed by them with multiple letters could probably get a restraining order but why bother? It costs them to send out letters so it is like they are paying a monthly fine for bothering folks.

The big joke is often that the non-licence payer genuinely never watches TV or is legally entitled to a free licence being over 75.

Aye! But the Englanders are legally subjects of the Sovereign Queen of England but there isn’t a Queen of Scotland – only a Queen of Scots and the Scots are legally sovereign and that makes her our legal subject and we can legally sack her if we wish. But there is an even more really great legal truth that few seem to have realise even although I’ve almost spelled it out for them many, many times. I had hoped someone would have realised the implication but I suppose I’d best throw it open for debate.

In 1688 the English Parliament deposed their rightful monarch, (he was also the monarch of the still independent Scots but the Scots had not deposed their monarch), Anyway, the English parliament skipped over a load of he more important royal line to the throne and invited Mary & William of Orange to be the joint monarchy of the Kingdom of England.

Now here comes the big legal problem The English Parliament only invited The pair as monarchs if they legally delegated their Divine right of Kings to the parliament of England, (this was English law but NOT Scots law), and the Divine right of Kings is also known as sovereignty.

So here’s the big legal problem for Westminster. If Scots who are legally sovereign have the legal right to sack their non-sovereign monarchy and have never legally delegated their sovereign right to the parliament of Scotland or to the parliament of the United Kingdom. Neither the Queen of England, The Queen of Scots or the Westminster parliament of the united Kingdom or even the Scottish parliament are sovereign over the people of Scotland and the Supreme court have just conceded the people of Scotland are legally sovereign.

Where does this claim of Westminster to be totally sovereign over Scots or Scotland legally come from? So when did the Scots agree to allow anyone to be sovereign?

But here is the clincher if it is ever needed – When England’s parliament prevented the Kingdom of England from becoming part of the Kingdom of Scotland as would have been legal under English law in 1603, (it was still then Divine right of kings), and the King of Scots was not allowed to just add his new inheritance to his existing kingdom of Scotland as it would have been under English law the English law claimed that as the King of Scots he first of all wasn’t sovereign so did not own Scotland but they ruled that a person just by being sovereign could not give away the sovereignty of the kingdom because the sovereignty belongs to the Kingdom and not to the king of the kingdom. So how then can England claim the sovereignty of Scotland if, under English law, it belongs to the kingdom of Scotland and the Scots as sovereign cannot legally give it away.

Complicated to get the head around but is actually a very logical conclusion.

I have been wondering – is there any link between what has happened to Wings, and the earlier disappearance from the internet of GA Ponsonby? His work was specifically focused on the BBC, and highly critical. His Twitter suddenly went down a few months ago. I was never able to find out out why – anyone know?

Are you sure it is the first video that they have issue with?

If the second video in the article, entitled “The bits that didn’t make it to air are below”, was never broadcast to the public by the BBC, then perhaps that is what they’re using as the excuse. Perhaps they claimed to YT that it was never their intention to show that footage and as such it remains theirs and theirs alone.

Heartening to see O’Brien really letting rip, but it’s a crazy, crazy world in the Twitter comments below clip. There is something profoundly unsettling about the Pro-Brexit comments who condemn O’Brien for what he says, many incandescent with rage and cynicism, but nowhere can I detect any cohesive, objective, and logically argued positions. It is anger for anger’s sake, bass emotion bordering on hysteria but without any tangible substance.

It’s a lot like our YES debate. Those for Indy had a wealth of arguments and substantive information, but Better Together simply recycled waffle and disinformation over, and over, and over again. Nobody then, or since, could present you with a progressive argument for keeping the Union.

How can people become so entrenched about a position which they cannot put into words? I don’t recognise education in these people. All I see is conditioning and mind control.

England is tearing itself apart. Remain is numerically inferior but with much better arguments which Brexit will prove true in due course, but Leave has the “agitated mob” on its side, angry, not listening, bought and sold with populist invective. It leaves you with the depressing conclusion that England could very well be on the brink of civil war, except the Remainers are too smart to start it, and Brexiteers for their part are too stupid to.

I just don’t want to be part of any of it. Brexit is the will of a country that is ideologically alien to me. Scotland’s future is in Europe. Why must I suffer the despair of somebody else’s insanity? FFS get us out of this Union.

I put a FOIA request into the BBC on Saturday for all records of contact between them and YouTube in the last year. No response as yet to confirm receipt of it, but I will be chasing progress today. There’s a few potential angles here where they may well be vulnerable as far as having to step into a court and be compelled to try and justify the clear political motivation behind this fiasco.

Presuming a positive outcome with respect to the reinatatement of the channel there would be no loss in terms of this site’s time and expense, but if Stu had to incur even say £50 expense in seeking legal advice, or £10 in terms of phone calls to YouTbe or the BBC for example, an interesting prospect arises. It would then be possible to raise a small claims action to recover that amount from the BBC.

They’d be bound to defend such an action as the prospect of setting that kind of precedent would be a nightmare for their legal dept. The interesting aspect of this tactic is that the cost for raising such an action (apart from representation) would only be £85 or so, and the BBC could also be compelled to justify the expenditure of defending such an action to any 3rd party who asked them to do so.

Just a thought. I will post any update as to the progress of the FOIA request, which I presume will have been duplicated by more than a few people given how obvious a step such a request is.

I have long since said that BBC should be challenged in a Scottish Court with the amount of Bias evidence available but that takes time to collate .

To be honest, even I’m stunned at this level of hypocrisy …and well …sheer stupidity. What on earth were the BBC thinking? What was discussed and what was it that invoked the BBC to have it removed? Talk about shooting yourself in the foot. Jeez!

They are absolutely panicking deep down as they finally realise that they have been caught in several traps of their own making and can’t work out how to return to those days pre-millennium where they were supremely in control. With the Internet and its freedoms, Brexit, the rise of Scottish nationalism and rebirth of Scottish culture and identity, the fear of a hard border in Ireland, a £2 Trillion pound debt, and absolute no chance of a decent trade deal, no matter if its is a Hard Brexit or not …they’re power and influence is dissipating on a daily basis. They know it, we know it, everyone knows it! …and because of that …it’s driving everyone of the Establishment to a form of utter madness and denial.

I know a man who would buy the site from you at that value (you would need a golden handcuff contract as editor in chief for 5 years on a good salary).

I don’t expect for one moment you would sell WoS, but that is not my reason for asking the question.

There is a more profound issue.

In valuing WoS when you posted that very first day, the WoS website value was say £200. Now you have built something that is worth a great deal. Monetising is not a good thing in this circumstance, but my thesis is if Scotland is ever to break free, we need to work very hard on getting these pages in front of Mrs McGubbings in Arbroath. The soft NO voter that reads the Sunday Post or Daily Mail. Those folk in Scotland who are not political anoraks and have no idea how bad Westinster and Tories are to Scotland.

We need Wings Over Scotland on media steroids.

I made a similar point around the time The National was born. Thank goodness the supermarket shelves are now fuller of The National and it does seem to be growng. That may buy us 2% more YES votes at Indyref2. But we need more.

The solution? Not quite Wings TV, but possibly a Scottish Youtube online television equivalent where ordinary folk can get readily available, high quality content.

Stuart Campbell, you have proven Wings Over Scotland has high quality content. Your readership numbers and £250,000 site value proves that.

How about we Winger Padowans help you financially start your own ScottishTV online channel?

How much would it cost to establish a stand-alone Scottish television media channel with video content?
