As far as we’re aware, today marks the first time the Scottish Government has formally acknowledged that transwomen are men. For our next trick, we’re going to send in an FOI asking if they know what religion the Pope is, or where bears go to the toilet.

Once again I have to thank Nicola and the clique for pushing me to be in agreement with people I’d rather not.
Johann Lamont was never one of my favourite people but she gave a stonker of a speech in Holyrood which certainly upped my opinion of her and took a great deal of courage on her part given the response from the SNP benches.
Johann Lamont was always a bit of a rebel. Of course they didn’t want ‘sex’ to be added to the Bill because the whole point was to distinguish between ‘trans’women and women, and only the former deserved protection because of being the most put upon and discriminated against people I’m the history of the planet. You can’t set out to remove all female rights and hand them to men in frocks unless you first get rid of the female voices. If you can’t say what misogyny is, you can’t complain about it. Anyone who still believes that it was not a deliberate intention to remove all female rights is living in Cloud Cuckoo Land. Maybe the politicians didn’t get it – I think a lot of them did, and welcomed it – but the shadowy people behind this stuff knew perfectly well what they were doing. Everything has to be performative with the SG – look at what we are doing for females (51-52% of the population) but we’ll still insist that ‘trans’women are women as if that is not discriminatory, offensive and midogynistic.

Oh God save us, not another f*****g law! Use the Common Law, you morons. It already exists to deal with this stuff, with just a few tweaks. No hate crime law, full stop, in statute form, please. Completely and expensively unnecessary. Every eejit and his dog has jumped on these statutes to hound and harass people for telling the truth or for ‘offending’ snowflake tw*ts. Just gather them all up and put them under the Common Law of Breach of the Peace which can carry a fairly hefty sentence.
The very last thing that women and girls need is to be marked by having a law all to themselves. May as well hang a placard round our necks. I’m not saying that women and girls do not need to have protection against misogyny, but men need it against misandry, if we are to have equality. The Common Law would sidestep all the various, individual groups, and intersectionality, and cover the bloody lot! Statute law has been created and, when it is not enforced, people scream: two-tier policing or two-tier justice.
The Common Law avoids all that nonsense, taking into account every individual incident, as well as the general situation fort each case. The existing law of Scotland is held in contempt by our politicians. The police have a big enough job to do without adding more and more useless, and, often, unenforceable, laws to the list and they need to understand each one both separately and how it interacts with all the other statute laws. It is onerous and unnecessary.

Totally agree, Lorn. It is clear that the current set in Holyrood, of all parties, have no idea on the existing law nor on how to draft new legislation.
The MSPs may mean well, in some cases, but they don’t realise that “difficult cases make bad law” i.e. that there are sad situations which they want to put right e.g. assisted dying, but which is impossible to render completely safe from abuse. Same with troubled souls who want to be the other sex.

My memory is that the excuse for NOT including sex from the start of the Hate Crime legislation was that men might abuse the provision. Therefore, a separate misogyny bill was touted, never happened, and would have included fake women anyway.
The point is not whether the law is fixable. Making hate a judicial crime at all opens up an Orwellian rabbit hole of nightmare depths and bifurcations every which way. Making it an equal opportunities Orwellian nightmare fixes nothing. The ultimate direction of all this unnecessary law is postmodern neoliberal lawfare.

A balanced post Lorn. We won’t make any progress until we declassified the bull dyke view of men. I have both Grandaughers and Grandsons. I am more fearful of my grandsons future. Behind in Education and seemingly no role in society going forward because it’s not appropriate to help them. Nicola’s legacy unfortunately we have to deal with the consequences. I was seeing off my son today who is leaving Scotland. No longer can I have a pint with him watching the fitba or rugby. And the grandchildren showed their emotions. Are we doing the right thing?. Absolutely their long term prospects are better elsewhere.But it is tantamount to grief in this household. 2 Doctors leaving Scotland. Who cares? Nobody.

EHRC ACTS OVER NON-COMPLIANCE WITH SINGLE-SEX SPACE LAW
Organisations with policies allowing people to use toilets based on gender self-identification have been instructed to remove or amend them by the Equality and Human Rights Commission (EHRC).
The EHRC is taking regulatory action against 19 organisations for wrongly suggesting that men and women who say they are transgender have a legal right to access single-sex spaces and services “according to their self-identified gender”.
The previous British Government submitted 404 examples of “potentially problematic guidance” to the watchdog for review in relation to non-compliance with EHRC interim guidance on the practical implications of the Supreme Court ruling on biological sex.
‘MISREPRESENT THE LAW’
Baroness Falkner, Chairwoman of the Equality and Human Rights Commission, said it acted where it had “identified policies that misrepresent the law”.
According to the EHRC, the affected organisations — which span policing, education, health care and public services — “must respond with assurances that policies will be withdrawn” and “set out any proposed timetable to revise their policies”.
It added: “The EHRC will monitor compliance and consider further regulatory action if necessary.”
The watchdog is currently updating its code of practice which will address the issue of single-sex spaces following the Supreme Court judgment that the definition of a woman is determined by biology not ideology for the purposes of the Equality Act 2010.
NON-COMPLIANCE
Whistleblowers from University College London have warned that the institution still allows biological men to use single-sex spaces reserved for women.
Its guidance states: “On campus, trans students can use ‘men only’ or ‘women only’ changing rooms or toilets according to which one they feel most comfortable in, or that they feel is most appropriate for them.”
Guidance on HMRC’s intranet also recently came under fire from gender-critical campaigners for advising employees who have ‘transitioned’ to “use the toilet appropriate to your new gender”.
And in Scotland, the City of Edinburgh Council has issued new EHRC compliant guidance for single-sex spaces in schools; it said the Scottish Government’s position on trans-identifying pupils was “in conflict with the law”.

Lorn, I agree. There is also the guid Scots Law of “nuisance”, which would cover dangerous dogs, behaviour at football matches, etc. Politicians must continually make new laws, i.e. restrict the people, to be seen to be doing something. How about them making people’s lives better instead?
And I don’t agree with aggravated factors either. A crime is a crime. The reason behind it is thought police territory, unless there are mitigating factors, such as self defence.

Breach of the Peace was and still is the catch offence used by Policec in Scotland to ‘ lift ‘ folks.

Becoming co-leader of a party with just over 300 votes from a membership of 7000 says a lot about the health not just of the Scottish Green Party but about Scottish democracy and politics more generally, none of it good I’m afraid.
I’m reading a book about Weimar Germany at the moment called “Vertigo”, and whilst I don’t really hold with there being any direct comparisons between their situation and ours, there does seem to be something in the air right now: a sense of foreboding which doesn’t augur well for the chances of people taking a punt on independence rather than the bromides of remaining in the union, however dysfunctional we think it is.
Perhaps things really do have to get worse before they get better? A Reform victory, or at least the prospect of one (even the prospect of Reform being part of a coalition or the biggest opposition party) might be the only thing which galvanises enough “frit” Scottish voters to actually grow a pair.

Slightly off topic but not much….the wackos at the Green Party have elected new co-leaders. What’s struck me was the number of votes cast. Less than a thousand equivalent to only 10% of the membership. Seems incredible to me.
Ever stop to think that maybe the Greens DON’T have their claimed 7,000 members? That maybe the 950 votes indicates the ACTUAL membership of the party?
Once you posit that the Green Party has exaggerated their actual membership (like the SNP does), then the voting numbers make more sense.
